At The Law Offices of Randy E. Lewis, LLC, we know how confusing things can be following a vehicle accident. You have many questions, and we are ready to answer them when you contact our Newark offices, 24 hours a day, seven days a week, at 973-297-4440.
The following are some of the most common questions we address from our clients who visit us after suffering serious injuries in a motor vehicle accident.
Do I Need To See A Doctor?
Your health and well-being are of primary concern following an accident. It is critical that you accept any treatment responders offer at the scene and follow up by going to the hospital or visiting your doctor.
Seeking an immediate medical evaluation serves two purposes:
- You will receive the care you need for your injuries and allow your doctor to monitor you for signs of hidden injuries.
- You will establish a record of medical care in case your insurer disputes your claim, or you decide to pursue a personal injury case.
Failing to have documentation that you sought medical care right away may jeopardize any claims for compensation or benefits.
What If I’m Partially Responsible?
New Jersey law uses the standard of comparative negligence. This means that in your personal injury claim, the court will determine the percentage of responsibility you shared in the accident.
If you are more than 50 percent responsible for your injuries, you will receive no damages. If you are less than 50 percent at fault, the court will reduce your award by the amount of responsibility you shared.
For example, if you were 10 percent responsible, your award will be 10 percent lower than the full amount of damages. Having a skilled lawyer on your side means having an advocate who will fight to maximize your claim.
Do I Need An Attorney?
An attorney can offer many advantages beyond in-depth knowledge of New Jersey’s personal injury and insurance laws. You will have access to many legal resources that will improve your chances of protecting your claim and meeting your goals. It is important to find a lawyer who has experience negotiating with insurance companies, communicating with other legal professionals and navigating the complexities of personal injury claims.
